Terms of Service

Mapiry is a free platform that allows users to create, customize, and share interactive maps. Our service is designed to work immediately without requiring an account. Features include:

• Creating custom maps with multiple locations and markers
• AI-powered map generation using natural language prompts
• Sharing maps via direct links or embedding them in websites
• Anonymous map creation (no account required)
• Optional user accounts for saving and managing maps across devices
• Map customization with colors, icons, and descriptions
• KML/KMZ file import from Google Earth and other mapping tools

You are responsible for safeguarding your password and for any activities or actions under your account. We encourage you to use strong passwords (a combination of upper and lowercase letters, numbers, and symbols).

Our service allows you to create, upload, and share content such as maps, locations, markers, descriptions, and images ("User Content"). You retain all rights to your User Content, but you grant Mapiry a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute your User Content for the purpose of providing and promoting our service.

You represent and warrant that:

• You own or have the necessary rights to use and authorize us to use your User Content
• Your User Content does not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights
• Your User Content does not contain material that is unlawful, defamatory, hateful, violent, or otherwise objectionable
• Your map locations and descriptions are accurate to the best of your knowledge

You agree not to use Mapiry:

• In any way that violates any applicable local, national, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our permission, including any "junk mail", "chain letter", or "spam"
• To impersonate or attempt to impersonate Mapiry, a Mapiry employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service, or which may harm Mapiry or users of the service
• To create maps that promote illegal activities, hate speech, violence, or harassment
• To abuse the AI map generation feature for inappropriate or harmful content
• To attempt to bypass rate limits or abuse our free service

The Mapiry name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mapiry or its affiliates. You must not use such marks without the prior written permission of Mapiry.

All content, features, and functionality of Mapiry, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Mapiry, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Mapiry uses third-party services to provide our mapping and AI functionality. Your use of Mapiry is also subject to the terms of service of these third-party providers:

We are not responsible for the terms, policies, or practices of these third-party services.

In no event shall Mapiry, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service, including user-generated maps and locations
• Unauthorized access, use, or alteration of your transmissions or content
• Inaccurate location data or map information provided by users

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
